3. Subject matter of the Agreement
3.1 This Agreement governs the conditions of use of the Service, the rights and obligations of the Parties, charging, and the termination of the agreement.
3.2 The Agreement applies to both the iOS and the Android version of the App and to the tomurcuk.app website. Platform-specific provisions are stated separately in the relevant articles.
3.3 The processing of personal data is not the subject matter of this Agreement. That subject is governed by the Privacy Policy and KVKK Notice and by the Explicit Consent Text.
4. Formation and entry into force of the Agreement
4.1 The Agreement is concluded electronically when the User approves this text in the registration flow, and enters into force at the moment it is concluded.
4.2 The Company records which version the approval was given to. The User can access a copy of the version they approved from within the Service at any time.
4.3 A person who does not accept the Agreement may not use the Service.
5. User eligibility
5.1 The Service is for persons 18 years of age and over. The User declares at registration that they have completed the age of 18.
5.2 If the Company determines that the User is under 18, it closes the account and deletes the related data.
5.3 The User declares that they have legal capacity to act and that they use the Service on their own behalf.
5.4 The User declares that there is no circumstance under the legislation of their country that prevents them from using the Service.
6. Account
6.1 A single method is used to create an account and to sign in: verification with a one-time code sent to the User's email address. No third-party sign-in provider (Sign in with Apple, Sign in with Google and the like) is used.
6.2 The Company does not store passwords. The sign-in code is kept as a cryptographic digest and becomes invalid after a short period.
6.3 The User declares that the email address they give belongs to them and is accessible to them.
6.4 The sign-in code is sent only to the registered email address. If the User loses access to that email account, their access to the Service may also be affected. The Company has no control over the User's email account.
6.5 The account is personal and cannot be transferred. The User is responsible for the actions carried out through the account.
6.6 If the User suspects that their account is being used without authorisation, they notify the Company without delay.
6.7 A User may have only one active Couple connection at a time.
7. Pairing and the Couple connection
7.1 Pairing is established when the invitation code produced by one User is entered by the other User.
7.2 Pairing is not affected by the Users being on different platforms. iOS and Android users can pair with each other.
7.3 The invitation code should be shared only with the person you want to pair with. The User is responsible for the consequences of sharing the code with third parties.
7.4 From the moment Pairing is established, the functions of the Service that produce Shared Content are opened to both Users.
7.5 Each User may end the Couple connection unilaterally. The consequences are set out in article 21.
8. How the Service works
8.1 Daily Question and Mühür. The same question is delivered to the Couple at the time it has set. After the User sends their answer, the Partner's answer is not visible until the Partner has also sent their own answer. This rule is enforced on the server side.
8.2 Answers cannot be changed. An answer that has been sent cannot be edited or taken back. The User is obliged to check the content of their answer before sending it.
8.3 Streak and Telafi. A day answered by both Users increases the Streak by one. A missed day can be repaired with a Telafi right within its quota. Telafi quotas are shown within the Service and can be changed by the Company.
8.4 Chat and notifications. The Couple can send text, photographs and voice messages within the Service. The Thinking of you (Aklımdasın) notification is subject to a quota. Quotas are set in order to prevent misuse of the Service.
8.5 Quizzes. Quizzes are entertainment content in which Users both answer for themselves and guess their Partner's answer. The results are not a scientific measurement.
8.6 Yuva and Kor. Kor is a point earned through actions within the Service and is used to acquire the virtual items in the Yuva section. The details are in article 16.
8.7 Sky. The Sky section is there for entertainment. The details are in article 18.
8.8 Platform differences. Depending on what the relevant operating system offers, some functions may work differently in the iOS and Android versions or may not be present in one version. The Company does not undertake one-to-one functional parity between the two versions.
8.9 Scope of the functions. The Company may change the functions, the quotas and the free/Premium division within the framework of article 19.
9. Shared Content and Partner access
9.1 By the nature of the Service, some User Content is visible to the Partner. This is in particular: unlocked Daily Question answers, chat messages and their media, completed quiz answers, and actions relating to Yuva.
9.2 The User cannot unilaterally make content that has become visible to the Partner invisible again. A deletion request does not remove the possibility that the content was previously seen, saved or screenshotted by the Partner.
9.3 The Company cannot technically prevent recording, screenshotting or exporting carried out on the Partner's device and cannot be held responsible for those actions.
9.4 The User acts in the knowledge that the content they enter into the Service can be seen by their Partner. It is advised that they not enter into the Service information they do not want to share.
9.5 If the Couple connection ends, access to Shared Content closes for both Users. The details are in article 21.
10. User Content and licence
10.1 User Content belongs to the User. The Company claims no ownership over User Content.
10.2 The User grants the Company a limited permission to use, so that the Service can be provided. This permission is valid only for, and limited to, the purpose of storing the content, delivering it to the Partner, backing it up and operating the Service.
10.3 The Company does not use User Content for advertising purposes, does not sell it to third parties and does not use it in the training of artificial intelligence models.
10.4 The User declares that they hold the necessary rights over the content they enter into the Service, and that the content does not infringe the intellectual property, personality or privacy rights of third parties.
10.5 When entering into the Service content that includes their Partner's personal data or image, the User is obliged to do so in a way consistent with their Partner's reasonable expectation.
11. Acceptable use
11.1 While using the Service, the User may not do the following.
- Produce or share content that is unlawful or that contains threats, insult, harassment, violence or hatred.
- Use the Service in order to monitor, put pressure on, frighten or control the behaviour of the Partner or a third person.
- Share images, audio or writing obtained without consent, or for the sharing of which no consent has been given.
- Produce, share or request any kind of content relating to the abuse of children.
- Impersonate another person or use someone else's invitation code without permission.
- Test the security of the Service without authorisation, reverse engineer it, attempt to access the source code, or collect data with automated tools.
- Attempt to exceed quotas and limits by technical means; operate mechanisms such as Kor or the Streak other than for their purpose.
- Use the App in a modified form, through copies obtained from unauthorised sources, or in environments where the device's security restrictions have been removed.
- Use the Service for commercial purposes, as an advertising or bulk messaging tool.
- Engage in behaviour that damages the Service, places excessive load on it or obstructs other Users' use of it.
11.2 The User is themselves responsible for the content they share through the Service.
12. Security, misuse and notification
12.1 In the event of harassment or misuse directed at them, the User may send a notification to destek@deerstudios.co.
12.2 The Company assesses infringement notifications within a reasonable time and, where it deems necessary, takes action under article 20.
12.3 The Company's obligations under Law No. 5651 are reserved.
12.4 If the User believes they are in urgent and serious danger, they should first apply to the competent authorities. The Service is not an emergency tool.
12.5 The Company takes reasonable technical and administrative measures for the protection of data. No system can be undertaken to be absolutely secure.
13. Free plan and Premium
13.1 The Daily Question ritual is free and will stay free.
13.2 The free plan covers the Daily Question and Mühür, Couple chat, the free quiz catalogue, quota-limited Thinking of you (Aklımdasın) rights, the archive of the last seven days, and the quota-limited Telafi right.
13.3 Premium covers the additional question categories, the full archive and the search function, the subscription quizzes, increased quotas, the additional content of Sky, and the full widget set.
13.4 One subscription covers both members of the Couple at once. The entitlement is defined at Couple level, not at User level.
13.5 Whichever Store the subscription was bought from, it is valid for both members of the Couple. The Partner being on a different platform does not change this result.
13.6 The current division between the free and Premium scopes is shown within the Service.
13.7 In the versions of the App that offer this function, alongside the Premium subscription there is also a product that is bought once: the Grand Harmony Report (Büyük Uyum Raporu). This product is not a subscription; it is bought once, does not renew by itself and gives rise to no recurring payment.
13.8 The Grand Harmony Report (Büyük Uyum Raporu) is a single report generated from the Couple's birth charts, and when it is generated it opens to both members of the Couple at once. The purchase is defined as a report entitlement on the account of the purchasing User; when the report is generated, that entitlement has been used. The report is generated once; it is not generated again afterwards.
13.9 The Grand Harmony Report (Büyük Uyum Raporu) falls within Sky. The provisions of article 18 on entertainment content and artificial intelligence apply to this report as well.
14. Payment, pricing, automatic renewal and cancellation
14.1 The Premium subscription is bought through the Store from which the App was obtained:
- In the iOS version through the Apple App Store; payment is collected from the User's Apple account.
- In the Android version through the Google Play Store; payment is collected from the User's Google Play account.
14.2 The purchase transaction is subject to the relevant Store's own terms. The Company has no control over the Stores' payment infrastructure.
14.3 The right to set and change prices belongs to the Company. The Company may freely set and change subscription fees, plan durations, package contents, trial periods, discounts and campaigns. Prices may differ by country and by Store.
14.4 A price change does not affect the User's current subscription period. The change applies from the first renewal period onwards.
14.5 Price increases are notified to the User before renewal and are applied in accordance with the rules of the relevant Store. Those rules may in some cases require the User's express approval. If the User does not accept the increase, they may cancel their subscription without renewing it.
14.6 Unless it is cancelled at least twenty-four hours before the end of the period, the subscription renews automatically. The renewal fee is collected within the twenty-four hours before the end of the period.
14.7 The subscription is cancelled from the account settings of the Store where it was bought. Cancellation takes effect at the end of the current period; access continues until the end of the period.
14.8 Deleting the App from the device does not cancel the subscription.
14.9 The User subscribes to Premium independently of their Partner. If the Couple connection ends, the subscription continues on the account of the purchasing User; the other User's Premium access ends.
14.10 The Grand Harmony Report (Büyük Uyum Raporu) is likewise bought through the same Stores and its price is again collected from the User's Store account. This purchase does not renew automatically; for that reason there is also no renewal period to cancel. The provisions in 14.2 and 14.3 apply to this product as well.
15. Right of withdrawal and refunds
15.1 The Premium subscription and the Grand Harmony Report (Büyük Uyum Raporu) are services performed instantly in an electronic environment. Under Article 15 of the Distance Contracts Regulation, there is no right of withdrawal in contracts of this kind.
15.2 The User accepts that, at the moment of purchase, they consent to the immediate performance of the service and that they therefore know they cannot exercise a right of withdrawal. This information is also given separately on the purchase screen.
15.3 Refund requests are directed to the Store where the purchase was made. For the Apple App Store the request is made through Apple's refund channel, and for the Google Play Store through Google's refund channel. The Store assesses the request within the framework of its own refund policy and, where it finds it appropriate, refunds the price to the User.
15.4 The Company does not run the Store's refund process and cannot intervene in the refund decision.
15.5 The User may also apply to the Company for a refund request at destek@deerstudios.co. The Company forwards the request to the relevant Store and keeps the User informed throughout the process.
15.6 The User's rights arising from Law No. 6502 on Consumer Protection are reserved.
16. Kor and in-app items
16.1 Kor is a point earned through actions within the Service.
16.2 Kor is not real money; it has no monetary value, no consideration and no convertibility into cash.
16.3 Kor cannot be bought, sold, transferred, moved to another account or refunded.
16.4 Kor is held at Couple level and is used jointly by both members of the Couple.
16.5 The User acquires no ownership right over the virtual items acquired with Kor; they obtain only a right of use within the Service.
16.6 If the account is closed, the Couple connection ends or the Service is discontinued, the Kor balance and the virtual items come to an end. No refund of any amount is made in that case.
16.7 The Company may change the earning and spending rates, the item catalogue and the pricing.
17. Intellectual property
17.1 The Tomurcuk name, logo, brand elements, interface design, software, question bank, quiz content and Sky text banks belong to the Company, or the Company holds the right to use them.
17.2 The User is granted a non-transferable and non-exclusive licence to use the Service within the framework of this Agreement and for personal, non-commercial purposes.
17.3 The User may not copy, reproduce, distribute or sell the content of the Service, produce derivative works from it or convert it into source code.
17.4 Shareable images produced within the Service (such as quiz result cards) may be used for personal use and sharing; the brand elements may not be removed.
18. Content generated by artificial intelligence and Sky
18.1 The content in the Sky section is for entertainment only. It carries no scientific claim.
18.2 This content is not medical, psychological, legal, financial or any other kind of advice, and should not be used as a basis for decisions.
18.3 A part of the Sky content is generated by artificial intelligence. Texts generated by artificial intelligence may contain errors. The Company does not undertake the accuracy of this content.
18.4 The Company transmits to the artificial intelligence provider only the minimum data needed for the content to be generated. The scope of that data is explained in the Privacy Policy and KVKK Notice. User answers, messages and quiz responses are not within that scope.
18.5 Tomurcuk is not a therapy, psychological counselling or relationship counselling service. Decisions about the relationship and their consequences belong to the User.
19. Provision of the Service and changes
19.1 The Service is provided "as is" and "as available".
19.2 The Company does not undertake that the Service will work without interruption, without error or compatibly with every device.
19.3 Access to the Service may stop temporarily because of maintenance, updates, infrastructure failure or reasons outside the Company's control. The Company tries to announce planned interruptions reasonably in advance.
19.4 The Company may change the functions, quotas and scope of the Service; it may add new functions or remove existing ones.
19.5 Changes that substantially affect the User's current paid entitlements are notified before they enter into force.
19.6 Functions marked as experimental or beta may work incompletely and may be removed without prior notice.
19.7 Using the Service requires a suitable device running a supported operating system version and an internet connection. The Company may change the lowest supported operating system version; in that case the Service may not work on older devices. Obtaining the device and the connection costs are for the User's account.
20. Suspension and termination
20.1 The User may delete their account from within the Service at any time. Deletion terminates the Agreement.
20.2 The Company may suspend the account or terminate the Agreement in the following cases.
- Breach of this Agreement, in particular of article 11.
- Unlawful use or a request from a competent authority.
- A concrete risk to the security of the Service or of other Users.
- A determination that the User is under 18.
20.3 To the extent the nature of the breach allows, the Company first issues a warning. In serious breaches, termination may be applied directly.
20.4 If the Company decides to discontinue the Service entirely, it informs Users a reasonable time in advance and allows a reasonable period for data to be exported.
20.5 Termination does not remove the payment obligations of the User that arose before the date of termination.
21. End of the connection and data retention
21.1 Each User may end the Couple connection unilaterally.
21.2 When the connection ends, access to Shared Content closes for both Users.
21.3 Shared Content is retained for 30 days from the end of the connection and is permanently deleted at the end of that period.
21.4 Within that period, to the extent technically possible, the option of reconnecting may be offered. The Company does not undertake that such an option will be available in all circumstances.
21.5 When the User deletes their account, the data relating to their own account is deleted. So as not to destroy the Partner's history early, the Couple record is preserved until the end of the retention period.
21.6 The details of the retention and deletion processes are explained in the Privacy Policy and KVKK Notice.
22. Personal data
22.1 The processing of personal data is carried out in accordance with Law No. 6698 on the Protection of Personal Data (KVKK) and the related legislation.
22.2 The scope of the processing activities, their legal grounds and the User's rights are explained in the Privacy Policy and KVKK Notice.
22.3 For processing that requires explicit consent, a separate Explicit Consent Text is presented. Açık rıza (explicit consent) can be withdrawn at any time.
22.4 The User may request a copy of their data from within the Service and may delete their account.
23. Commercial electronic messages
23.1 The Company may in any event send the User the mandatory notifications relating to the operation of the Service (verification code, security warning, change of agreement). These are not commercial electronic messages.
23.2 Commercial electronic messages containing promotional and campaign content are sent only with the User's approval. Approval can be withdrawn at any time.
23.3 In-app notifications can be switched off from the device settings.
24. Limitation of liability
24.1 Cases in which liability cannot be limited by law, and the User's rights arising from consumer legislation, are reserved.
24.2 Within that limit, the Company is not liable for indirect damages, loss of profit, loss of data or failure to obtain an expected benefit.
24.3 The Company's total liability is in every case limited to the amount the User paid for the Service in the twelve months before the date on which the event giving rise to the dispute occurred.
24.4 The Company is not liable for the User's relationship with their Partner, for the Partner's behaviour or for the Partner's actions with Shared Content.
24.5 The Company is not liable for the interruptions, errors and practices of the Stores, the operating system providers or other third-party services.
24.6 The Company is not liable for damages arising from the User's use of the Service contrary to this Agreement.
25. Force majeure
25.1 Natural disaster, epidemic, war, cyber attack, general interruptions in the electricity or internet infrastructure, decisions of competent authorities and similar events outside the Parties' control are deemed force majeure.
25.2 For the duration of the force majeure, performance of the obligations is suspended. If the force majeure lasts longer than thirty days, either Party may terminate the Agreement.
26. Special provisions relating to the app stores
26.1 Scope. Where the App is obtained through the Apple App Store or the Google Play Store, this article applies with respect to the Store from which the User obtained it.
26.2 The Stores are not parties. This Agreement is between the User and the Company. Apple Inc. ("Apple") and Google LLC ("Google") are not parties to the Agreement. Only the Company is responsible for the content and the operation of the App and for this Agreement.
26.3 Store terms. When obtaining the App and when making a purchase, the User is also obliged to comply with the relevant Store's own terms of use.
26.4 Apple — scope of the licence. The licence for the App is granted for use on Apple-branded devices that the User owns or controls, within the framework of the Usage Rules in the App Store Terms of Service.
26.5 Apple — maintenance and support. Only the Company is responsible for the maintenance and support services of the App. Apple has no obligation whatsoever in this respect.
26.6 Apple — warranty. If the App fails to conform to any warranty, the User may notify Apple; Apple refunds the purchase price, if any. Apple has no warranty obligation beyond that.
26.7 Apple — claims. The Company, not Apple, is responsible for meeting claims relating to product liability, compliance with legislation, consumer protection and the like.
26.8 Apple — intellectual property. Only the Company is responsible for investigating and meeting allegations that the App infringes the intellectual property rights of third parties.
26.9 Apple — legal declaration. The User declares that they are not located in a country subject to a United States government embargo and that they do not appear on lists of prohibited parties.
26.10 Apple — third-party beneficiary. Apple and its affiliates are third-party beneficiaries of this Agreement and have the right to enforce its provisions against the User.
26.11 Google Play — scope of the licence. The licence for the App is granted, within the framework of the Google Play Terms of Service and the Google Play Terms of Use, for use on Android devices that the User owns or controls.
26.12 Google Play — maintenance, support and warranty. The maintenance and support of the App and the meeting of any claim relating to the App are the responsibility of the Company alone. Google has no obligation whatsoever in this respect.
26.13 Google Play — refunds. For purchases made through Google Play, refunds are subject to Google Play's refund policy. Requests made within a certain period may be processed directly by Google; after that, the request may be forwarded to the Company.
26.14 Google — distribution. Google is only the distribution channel for the App; it assumes no liability as the seller or the producer of the App.
27. Changes to the Agreement
27.1 The Company may change this Agreement.
27.2 Substantial changes are notified from within the Service or by email before they enter into force.
27.3 Continuing to use the Service after notification means acceptance of the current version.
27.4 A User who does not accept the change may terminate the Agreement by deleting their account.
28. Assignment
28.1 The User may not assign the rights and obligations arising from this Agreement.
28.2 The Company may assign the Agreement in the event of a merger, division, change of legal form or transfer of the business. The assignment does not reduce the User's rights and is notified in advance.
29. Notices and contact
29.1 The Company gives its notices to the User at the registered email address or by way of an in-Service notification.
29.2 The User gives their notices to the Company at destek@deerstudios.co or at the address in article 1.
29.3 The User is obliged to keep their email address up to date.
30. Applicable law and dispute resolution
30.1 This Agreement is subject to Turkish law.
30.2 The courts and enforcement offices of Ankara are competent in disputes.
30.3 Where the User holds the status of consumer, their right to apply, according to the monetary limits, to the Consumer Arbitration Committees and the Consumer Courts of their place of residence is reserved.
30.4 The Parties first try to resolve the dispute in good faith.
31. Other provisions
31.1 Severability. A provision being held invalid does not affect the validity of the other provisions. The invalid provision is deemed replaced by the valid provision closest to its purpose.
31.2 Waiver. The Company not exercising one of its rights does not mean that it has waived that right.
31.3 Entirety. This Agreement, together with the Privacy Policy and KVKK Notice and the Explicit Consent Text, constitutes the whole of the agreement between the Parties.
31.4 Language. The Turkish text of the Agreement is authoritative. Translations are for information purposes and in case of conflict the Turkish text applies.
31.5 Headings. The article headings are for convenience only and are not taken as a basis in interpretation.
32. Entry into force
32.1 This Agreement consists of 32 articles and enters into force upon the User's approval in an electronic environment.
32.2 The User declares that they have read and accepted the whole of the Agreement.
