Tomurcuk Explicit Consent Text

Version 1.6 · 23 September 2026

This is a convenience translation of the Turkish original. The Turkish text is the binding one; in case of any discrepancy the Turkish version prevails. The version and date above are those of the Turkish original.

How it works

1. What this text is

1.1 This text sets out the processing activities submitted to your explicit consent under the Turkish Personal Data Protection Law No. 6698 ("KVKK").

1.2 Which of your data we process for which purpose, to whom we transfer it and what your rights are is explained in the Privacy Policy and KVKK Notice. This text does not replace it; it supplements it.

1.3 The processing required for Tomurcuk to function rests not on explicit consent but on the performance of the contract and on other legal grounds. Only the optional ones appear in this text.

2. Data controller

Deer Studios Bilgisayar Yazılım Hizmetleri Danışmanlık E-Ticaret İthalat İhracat Limited Şirketi · Üniversiteler Mah. 1597 Cad. No: 3 İç Kapı No: 127 Çankaya / Ankara · destek@deerstudios.co

3. Conditions of explicit consent

3.1 Free will. Whether or not you give consent is entirely up to you. If you do not give consent, you are not prevented from using the service, your account is not closed, and you are not charged a different price.

3.2 It is not a condition of the service. Explicit consent is not presented as a precondition for using Tomurcuk.

3.3 It is given separately. The permissions below are not gathered into a single box. A separate consent is taken for each one and you may choose whichever you wish.

3.4 It rests on information. Next to each permission it is stated what it means, why it is requested and what happens if you do not give it.

3.5 It can be withdrawn at any time. Withdrawal is done from the place where you gave the consent. Your withdrawal does not invalidate processing that was carried out lawfully up to that moment.

4. Processing submitted to your consent

4.1 Special category data you enter into free text

What happens. Tomurcuk contains fields that do not limit what you may write: daily question answers, chat messages and quiz notes. The Intimate (Mahrem) category in the question pool may lead you to share information concerning your sexual life. Information of this kind is special category personal data within the meaning of Article 6 of the KVKK and its processing depends on your explicit consent.

Why. So that what you write can be stored and shown to your partner.

Limit. We do not read this content, do not analyse it, do not categorise it, do not include it in analytics and do not send it to artificial intelligence.

If you do not give it. The app keeps working. The Intimate (Mahrem) category is off as long as no member of the couple has given this consent, and no question from this category is drawn. That said, the category is a setting not at the level of the person but at the level of the couple, and the design chosen is this: a single member of the couple giving this consent opens the category for the whole couple; no further action is needed for this. The plain consequence of this is the following, and it is not hidden from you: even if you have never given this consent, once your partner gives it a question from this category may be drawn for you as well. The right you hold against this is the following: you do not need to have given consent in order to turn the category off. Either member of the couple can turn Intimate (Mahrem) off at any time from Settings → Question Categories; when you turn it off, the category closes for both members at once and no question from this category is drawn for you. The only condition for this is that at least one other question category remains on — the app does not allow all categories to be turned off at the same time, so another category must be on for you to be able to turn Intimate (Mahrem) off. Turning a category that has been turned off back on, however, does require this consent: a member who has not given consent cannot turn Intimate (Mahrem) back on. You are also not obliged to answer any question; no data is processed from you for a question you do not answer. What you write in the other categories continues to be processed to the extent that it does not contain special category data.

If you withdraw it. When you withdraw your consent, if no other member of the couple still has consent in place, questions from this category stop coming; you do not need to take any further action for this. If your partner keeps their own consent in place, the category may stay open; in that case you can turn the category off yourself from Settings → Question Categories as described above — you do not need to have given consent for this. Since turning the category back on after it has been turned off requires consent, you cannot open Intimate (Mahrem) again from then on. In any event, the content you have entered within this scope is deleted upon your request.

4.2 Your location information

What happens. Only the city name is derived from your device's location and shared with your partner.

Why. So that your partner can see which city you are in and your local time. It is a function designed for long-distance couples.

Limit. Your coordinates are converted into a city name through the operating system's geocoding service (Apple on iOS, Google on Android); this conversion requires a network request and the coordinates go to the relevant operating system provider for this purpose only. Under this permission your coordinates are not sent to us and not stored by us; storing a rounded location depends on a separate permission (4.4). No location history is kept.

If you do not give it. Your partner sees only your time difference, not your city. No location permission is needed for the time difference.

If you withdraw it. The recorded city information is deleted and no new one is derived. If your distance permission is on, the distance is no longer shown either and the stored rounded point is deleted at once (4.4). Ending your partner connection also counts as withdrawing this permission: whether it is one of you who breaks the connection or one of you who deletes their account, the recorded city information is deleted at once for both of you and city sharing is turned off on both sides. The permission does not come back by itself when you pair again; whoever wants it gives it anew.

4.3 Transfer abroad

What happens. In order for the service to be provided, some of your data is transferred to providers abroad. The list of the providers and the data transferred are in section 8 of the Privacy Policy and KVKK Notice.

Why. Hosting, e-mail delivery, notification delivery, subscription verification and the generation of Sky texts are carried out through these providers.

Limit. For transfers, the appropriate safeguards in Article 9 of the KVKK are applied in the first place. Your explicit consent is requested only in respect of occasional transfers for which no appropriate safeguard is available.

If you do not give it. Transfers that rest on an appropriate safeguard are not affected; the service keeps working.

4.4 The distance between you

What happens. Your device's location is written to our servers rounded to about one kilometre. This point is used only to calculate the distance between you and your partner in kilometres; your partner is shown only that number.

Why. So that you can see how far apart from each other you are. It is a function designed for long-distance couples.

Limit. Your exact location is not stored; only the rounded point and the moment it was taken are stored. No location history is kept; each new point takes the place of the previous one. Your coordinates are never sent to your partner's device. The plain consequence is this, and it is not hidden from you: a partner who sees the distance can, as their own position changes, work out from that number roughly where you are. The point begins to be stored as soon as you give this permission; for the distance to be shown, your partner must have given it too. The function works only while city sharing (4.2) is on. The point is refreshed when you open the app and when the home screen widget reloads. A point older than seven days is not used.

If you do not give it. The distance is not shown. Your city and the time difference are not affected by this.

If you withdraw it. When you turn this permission, or the city permission, off inside the application, the stored point is deleted at once and no new one is written; your partner cannot see the distance either. Withdrawing the location permission at the level of your device's operating system has the same effect; but because the application can notice this only when it next opens, the stored point is deleted the next time you open the application. Until then no new point is written either, and a point older than seven days is not used in any case. Ending your partner connection also counts as withdrawing this permission: whether it is one of you who breaks the connection or one of you who deletes their account, the stored point is deleted at once for both of you and distance sharing is turned off on both sides. The permission does not come back by itself when you pair again; each of you gives it anew if they wish.

5. Consent for commercial electronic messages

5.1 Messages containing promotions, campaigns and announcements of new features are sent only if you give a separate consent.

5.2 This consent falls within the scope of the Law No. 6563 on the Regulation of Electronic Commerce and is recorded in the Message Management System (İleti Yönetim Sistemi).

5.3 If you do not give consent, only mandatory notifications concerning the operation of the service are sent: login code, security warning, notification of a change to the agreement. These are not commercial electronic messages and cannot be refused.

5.4 You can withdraw your consent from the link inside each message, from the app settings or through the Message Management System.

6. How you withdraw your consent

6.1 Inside the app it is enough to turn off the relevant switch under Settings → Privacy.

6.2 If you wish, you can also withdraw it by writing to destek@deerstudios.co.

6.3 Your withdrawal request is concluded without delay and in any event within thirty days.

6.4 Withdrawal does not render unlawful the processing that was carried out on the basis of explicit consent up to that moment.

7. Keeping of records

7.1 Which permission you gave, on which date and against which version of the text is recorded.

7.2 You can access a copy of the text you consented to from inside the app at any time.

7.3 When this text changes, existing consents do not pass to the new version by themselves. In the event of a change that broadens the scope, your consent is requested again.

8. Declaration

I declare that I have read the explanations above, that I have chosen separately which processing I consent to and which I do not, and that I know that my consent is not a precondition of the service and that I may withdraw it at any time.

Ek-1 — Version history

VersionDateChange
0.117 August 2026First draft.
1.030 August 2026Release version. Draft notes and the lawyer's questions were removed; the in-app consent texts were moved to the acik_riza_ui_copy.md file.
1.12 September 20264.1 amended: the Intimate (Mahrem) category is a couple-level setting, and consent determines only who can open the category. "If you do not give it" and "If you withdraw it" were rewritten so as to describe this behaviour as it is; it was stated expressly that either member of the couple can turn the category off unconditionally (Settings → Categories). An exception concerning this was added to the withdrawal sentence in the "How it works" section. In 4.2 it was corrected that the conversion of the coordinates into a city name is not carried out on the device but is a network request carried out in the operating system's geocoding service.
1.22 September 20264.1 rewritten. The Intimate (Mahrem) category is now off for every couple, paid or not, and can be turned on from Settings only after at least one member of the couple has given this consent; a member who has not given consent cannot open the category, while the opening of it by a single consenting member opens the category for the whole couple. If, after a member withdraws their consent, no one in the couple still has consent in place, questions from this category stop coming by themselves. The condition for the right to turn the category off was corrected: consent is not required in order to turn it off, but at least one other category must remain on. The menu name was aligned with the "Question Categories" label shown on the screen.
1.32 September 20264.1 amended: the opening of the Intimate (Mahrem) category is not a two-step but a one-step action. One member of the couple giving this consent opens the category for the whole couple; no separate opening action from Settings is needed. "If you do not give it" and "If you withdraw it" were cleared of wording implying a second opening step. That either member can turn the category off without consent and that at least one other category must remain on were kept exactly as they were; in addition, it was stated expressly that turning back on a category that has been turned off requires this consent. The substance of the text has not changed: the explanation that the partner's consent may cause questions to be drawn for you as well stands as it was in 1.2.
1.420 September 2026A new permission was added: 4.5 The distance between you. It was written that the device location, rounded to about one kilometre, is written to our servers, that it is used only to calculate the distance between the two members, and that the partner is shown only the number of kilometres. It was declared expressly that a partner who sees the distance can, as their own position changes, work out from that number roughly where you are. It was stated that the permission is separate and can be given only while the city permission (4.2) is on; that the point begins to be stored on the person's own permission, whereas the distance is shown only when both members of the couple have given it; that the stored point is deleted at once when it is withdrawn through the in-app switches, and the next time the application opens when it is the operating-system location permission that is withdrawn instead; and that a point older than seven days is not used. The undertaking about coordinates in the "Limit" of 4.2 was amended so as to show the exception of the new permission: that the coordinates are not sent to us and not stored by us is now stated in respect of the scope of that permission. It was added to the "If you withdraw it" of 4.2 that withdrawing the city permission also deletes the stored point. The exception that the distance permission depends on the city permission was written into the rule about permissions being given separately in the "How it works" section. It was written into the "If you withdraw it" sections of 4.2 and 4.5 that ending the partner connection also counts as withdrawing these permissions: if one of you breaks the connection or one of you deletes their account, the recorded city information and the stored point are deleted at once for both sides, and the permissions do not come back by themselves on a new pairing. The existing section numbers did not change.
1.523 September 2026The functions now released were described in the present tense; the statement mentioning Live Activity support, which the app does not have, was removed. The device's time zone was added so that notifications are sent by local time.
1.623 September 2026Analytics was removed from the processing that rests on explicit consent; it rests on legitimate interest and can be turned off from within the app (Privacy Policy and KVKK Notice 3.7–3.8).
